Report on ongoing interinstitutional negotiations

  • with regard to the banking package, the second trilogue on Capital Requirements Directive and Regulation (CRR and CRD) took place on 18 April;
    • co-legislators continued discussions on the output floor, and addressed topics of fit and proper, third-country regimes, supervisory independence, environmental, social and governance (ESG) risks, and prudential treatment of crypto-assets;
    • a mandate for technical work was given and political discussions would continue at the next trilogue, scheduled for 10 May 2023;
  • the first trilogue on Markets in Financial Instruments Directive and Regulation (MiFID and MiDIR) took place on 18 April:
    • the Parliament exchanged views with the Council on the two main political matters: the consolidated tape regime, and the ban on payments for order flow (PFOF);
    • interinstitutional negotiations would continue at technical level, and the second trilogue was expected to take place on 8 May 2023;
  • on Central Securities Depositories Regulation (CSDR), the first trilogue took place on 18 April;
    • the most important issues of the file were identified and discussed: settlement discipline and mandatory buy-in, authorisation and supervision, the regime for third-countries CSDs, banking-type ancillary services, and newly introduced issues on netting and procedures in respect of qualifying holdings in CSDs;
    • a broad mandate was given for technical work, and the date for the next trilogue would be fixed in the light of progress on that work.
